General Terms and Conditions of Sale

Sales on the digital3d.com website are made by David Dolinski, a sole proprietorship operating under the name Digital3D, Rue Célestin Cherpion 17, 1390 Grez-Doiceau, Belgium. Company and VAT number: BE 0558.686.841.

All our products are digital. They are paid for online and used with a customer account on digital3d.com.

Prices are indicated in euros, including VAT. The exact amount, including the customer's country's VAT, is displayed on the payment page before confirmation. Details of each offer, including its quotas, are provided on its sales page at the time of purchase.

Payment is made by credit card or by another method offered on our payment provider Stripe’s secure payment page. Digital3D neither sees nor stores card details. The bank may ask you to confirm the payment (3D Secure).

By confirming the order, the customer accepts these terms and conditions. A receipt is sent to them by email after each payment.

The first subscription to the Digital3D Toolbox includes a 30-day free trial, available only once per account. A card is required at sign-up, but nothing is charged during the trial. A reminder is sent by email 7 days before the end of the trial.

If you do not cancel before the end of the trial, the paid subscription starts automatically and the first month is charged that day.

Subscriptions are entered into for one month or one year, depending on the plan chosen. They renew automatically for the same duration, at the current price, with a charge at the beginning of each period. A reminder is sent by email before an annual subscription renews.

A price change is announced by email at least 30 days before taking effect; the customer may cancel free of charge before that date.

The customer can cancel at any time, with one click, from their account. The cancellation takes effect at the end of the period already paid for: access remains open until then and no new charge is made.

Consumer customers generally have 14 days from the conclusion of the contract to withdraw without giving a reason.

• Software and licenses: at the time of payment, the customer requests to be able to use them immediately and acknowledges thereby losing their right of withdrawal upon first access (Article VI.53, 13°, of the Code of Economic Law).
• XMLTV TV Guide and APIs: as this is a service, a customer who has requested to benefit from it immediately and withdraws within 14 days will be refunded pro rata for the unused period.
• Toolbox with free trial: the contract is concluded upon registration for the trial; the 14-day period starts on that day and ends during the trial. A customer who does not wish to continue must cancel before the end of the trial, without any charges.

To withdraw, simply write to support@digital3d.com.

Aside from the right of withdrawal, a started period is not refundable. We always refund a payment charged in error or twice, and a payment that the cardholder's bank reports as fraudulent.

For any refund request, write to us before disputing the payment with your bank: we respond within 48 business hours.

A software license is personal and non-transferable. It remains valid for the duration of the paid subscription, for the number of devices indicated by the offer: 3 for Toolbox and for a subscription to an application, 1 or 5 for ShopPoint and WWShop. The customer may release a device from their account, within the displayed limit.

Quotas (XMLTV downloads, API calls) are those of the offer at the time of use; they protect the service against abuse. It is prohibited to share an account or an API key, resell access, or bypass quotas and license controls.

Digital3D may suspend an account, without refunding the current period:

• when the bank reports a payment as fraudulent, or when the customer disputes a payment with their bank (chargeback);
• in the event of a breach of Article 9.

During the suspension, access to and use of the software and APIs are blocked. The customer may write to support@digital3d.com to regularize their situation.

We do our best to keep the services available at all times, but cannot guarantee this (maintenance, hosting outages, third-party sources for the TV guide). The software is provided as is.

Our liability is limited to the amount paid by the customer during the last 12 months, except in the event of gross negligence or intentional misconduct and except for personal injury.

The processing of customer data is described in our privacy policy.

The applicable terms are those in effect on the date of the order. A new version applies to the next renewal if it was announced by email at least 30 days in advance.

These conditions are subject to Belgian law. In case of disagreement, please write to us first at support@digital3d.com.

The consumer customer may also contact the Consumer Mediation Service free of charge, Boulevard du Roi Albert II 8, 1000 Brussels (mediationconsommateur.be). They retain the mandatory rights granted to them by the law of their country of residence.
